Third Round of Public Consultation on IP Rights Reforms
IP Australia is seeking comments from the public on draft legislation designed to strengthen and improve Australia's IP system.
Previous Consultation
Throughout 2009 and 2010 IP Australia conducted public consultation on proposals to improve the Australian IP system. The previous consultation papers can be found here.
Draft Intellectual Property Laws Amendment (Raising the Bar) Bill 2011
IP Australia has considered stakeholder submissions as part of the previous consultations and developed a draft Bill to give effect to the proposals. The draft Bill and an accompanying draft explanatory memorandum can be accessed here:

Please note that the draft Bill does not deal with gene specific issues, rather it seeks to raise patentability standards across all technologies. Gene specific issues are being considered separately by the Senate Legal and Constitutional Affairs Legislation Committee, and by the Government in its response to the Senate Community Affairs Committee’s Gene Patents report.
Submissions
IP Australia invites interested stakeholders to make a written submission on the draft Bill and explanatory memorandum.
The deadline for written submissions is 4 April 2011. Submissions should be sent by email to This email address is being protected from spambots. You need JavaScript enabled to view it._">This email address is being protected from spambots. You need JavaScript enabled to view it..
IP Australia will consider submissions prior to finalising the Bill.
